New Automated Decision-Making Transparency Requirements and the Changing Privacy Landscape

On 10 December 2026, automated decision-making transparency obligations under the Privacy Act 1988 (Cth) (Privacy Act) will come into effect and organisations must prepare for new transparency obligations relating to automated decision-making technologies, including AI-enabled systems, automated assessment tools and algorithm-driven decision processes. 

 

Further, the Office of the Australian Information Commissioner (OAIC) has renewed its focus on organisations ensuring that their privacy policies are compliant with the Privacy Act and has been undertaking a "compliance sweep" of privacy policies. 

Background: How Privacy Act changes apply to the Aged Care Sector

The Aged Care Act 2024 (Cth), establishes sector-specific information obligations that operate alongside the Privacy Act, requiring aged care providers to comply with both frameworks when delivering funded aged care services. Australian Aged care providers handle some of the most sensitive personal information including medical records, care assessments, financial details and family contact information.

  • Aged Care Act 2024: Section 21 applies to ‘Protected Information’

  • Aged Care Act 2024: Section 168 applies to ‘personal information relating to an individual to whom the registered provider delivers funded aged care services

  • Aged Care ACT 2024: Chapter 7 applies to dedicated 'Information Management Framework' covering secrecy of information, record keeping, reporting, information sharing and whistleblower protections
