Course Overview

2020 has undoubtedly been an incredibly tough year for businesses across the country, with the impacts of the COVID-19 pandemic taking its toll. Now is the time to adapt to avoid potential regulator scrutiny down the line, particularly with business contracts.

Preparing and negotiating contracts is vital for achieving business success. If not executed carefully, contractual mistakes can be extremely costly to the business when things go wrong. With most businesses operating in a global environment, the complexities of business and legal red-tape, constantly changing legislation and cross-border transactions can be overwhelming. One missed point could be the downfall of a business, particularly with increasing regulator intervention and media scrutiny, and the added challenge of applying laws in an online marketplace. Learn how to ‘pandemic’ proof your business contracts, plus clauses you should include to protect your business and minimise the risk to you personally.

If you are a business owner or the person responsible for managing, reviewing or entering into any business contract, this half-day training course is essential.

Prepared and presented by legal experts from the Commercial Team of the Year 2020, this course will provide valuable insights on:

Contracts 101 – Key elements of an enforceable and compliant Contract
With a focus on key contract terms, tips and tricks, enforceability and case studies of unfair contract terms and competition and consumer law basics, learn the essentials of best practice contracting for business, including how to pandemic proof your contracts and validly sign contracts electronically.

- How to limit and exclude your business’ risk – A guide to Warranties and Indemnities
Break down the most technical and most important aspect of contracts, with a practical guide to limitation of liability, warranties and indemnities, including negotiation tips, and an overview of how to comply with consumer warranties and guarantees.

- E-contracting and other digital trends
Explore how to best engage with your customers to ensure you have enforceable, binding contracts, with an overview of trends in the digital and e-commerce marketplace, click-wrap and browse-wrap online agreements, and other website terms and conditions and policies

- International contracting plus Contract Negotiation Tips
With an increasingly global, online marketplace, whether you are an international based business or may have international customers, suppliers, manufacturers, group companies, or do business online through your website, learn our expert tips for international contracting

- Contracts gone bad: Breach, Termination and Disputes
Learn how to avoid breach of contract and what to do if the other party is in breach, with our best practice guide and case studies to show you how to avoid and manage contract disputes, and how to lawfully terminate contracts.
