What is Legitimate Sexpectations?

When should a promise be kept? This is what the legal doctrine of 'legitimate expectation' is concerned with in the common law world..... In Australia ... in essence it asks: "When are individuals entitled to rely on promises made by public bodies? Promises from those with the power to make decisions that impact individual lives? When is it reasonable to expect those promises will be kept? .... What expectations do we have of the way we will behave in a sexual encounter? How do we expect our institutions to respond? What expectations do young people have of their futures? Can we promise our kids that they will live a life free from sexual violence, that their sexual wellbeing will be protected at all costs? Can future generations hold a legitimate expectation that we will make good on that promise, to do everything in our power to give them the very best chance? When should a promise be kept?" Katrina Marson is a Criminal lawyer with extensive experience in family violence and sexual offences. Multiple award winner, member of the Australian Government Respectful Relationships Education Expert Working Group, Director of the team responsible for implementing the criminal justice recommendations of the Royal Commission into Institutional Responses to Child Sexual Abuse in the ACT, and Author of Legitimate Sexpectations.
