Let’s talk about confidentiality: NDA use in sexual harassment settlements since the Respect@Work Report will be presented by Regina Featherstone and Sharmilla Bargon, who will speak about their empirical research conducted as the inaugural University of Sydney Social Justice Academics in Residence, investigating how Australian lawyers use NDAs to settle sexual harassment matters.
This hour-long session will detail how Australian practitioners responded to recommendations around NDA use which emerged from the Respect@Work Report and discuss the effectiveness of these reforms. The researchers will discuss how settlement practices might sit with the new positive duty for employers to prevent sexual harassment. They will also speak about how other jurisdictions have addressed the ‘silencing’ of complainants’ (victim-survivors) experiences when resolving sexual harassment matters and reflect on how the Australian legal profession may respond to this issue.
