Level 22 Chambers invites you to join Commissioner Janet McDonald of the IRC, along with Katherine Hooper and Jackson Rogers of Level 22 Chambers for an in-conversation discussion on recent costs decisions and the ethical implications arising for solicitors.

Topics to be canvassed include:

  • The recent High Court decision of Birketu v Atanaskovic [2025] HCA 2 in relation to the costs of employed solicitors, where the firm is acting in proceedings for its own fees.
  • Recent developments in relation to costs estimates and disclosures.
  • The inherent supervisory jurisdiction of the Supreme Court of New South Wales over the conduct (and charging) of solicitors (with reference to Hartnett v Bell)
  • Multiple solicitors and counsel attending trial (and the most recent decision in the long-running Macquarie International Health v Sydney Local Health District litigation)
  • The use by costs assessors of findings of fact in judgments to which the costs relate and how solicitors might respond to this situation
  • The ethical approach to notices of appeal in costs appeals
  • Personal costs orders for solicitor misconduct.

The seminar will be presented by Level 22 Chambers’ Katherine Hooper and Jackson Rogers.  It will be chaired by Level 22 Chambers alumni, Commissioner Janet McDonald.
