    • Understand your right as a manager to performance manage and gain the confidence to put your knowledge into practice.
    • Gain an understanding of the risks (both legal and non-legal) of poor performance management. 
    • Gain sound knowledge of the termination process.

    Course Overview

    Low employee morale, interpersonal issues, high staff turnover and wasted resources are just some of the negative consequences of poor performance management, not to mention the associated compliance risks and hefty legal costs. The effects of poor performance management can have a long-lasting impact on the wider business and if not dealt with correctly could severely damage your organisation and may also land you in the Fair Work Commission dealing with unfair dismissals.

    Conversely, when done well performance management directly impacts the success of your organisation by ensuring staff are held accountable whilst also being supported to perform at the highest standard.

    Join our legal expert for this online training event that will provide you with the tools and tips to manage difficult employees, understand your legal rights and obligations as an employer and minimise the chance of an unfair dismissal case or other forms of legal proceedings you just can’t afford.

    This training will cover:

    • Interrelation between performance and workplace culture
    • Balancing informal intervention and formal performance management procedures
    • Documenting performance management discussions, formal and informal
    • Drafting warnings
    • Termination of employment and the associated process
    • Legal risks associated with performance management and resulting dismissals

      About the trainer

      Caitlin Vincent
      Associate Director
      Australian Business Lawyers & Advisors (ABLA)

      Caitlin commenced her employment with Australian Business Lawyers & Advisors in May 2019.  Prior to joining Australian Business Lawyers & Advisors, Caitlin worked at a top tier law firm in Sydney.
       
      Caitlin is an experienced member of the workplace team and has broad ranging expertise providing commercial advice to clients, allowing them to resolve their employment problems with limited business disruption.
       
      Caitlin’s employment/industrial law expertise includes:

      • Employee claims (unfair dismissals, general protections and workplace bullying);
      • Employment contracts and policies;
      • Workplace Investigations;
      • Modern Award interpretation and compliance;
      • Restraint of trade;
      • Performance management;
      • Management of ill or injured employees;
      • Termination (performance, capacity or conduct);
      • Workplace surveillance and privacy;
      • Employee transfer during takeovers, mergers, and acquisition; and
      • Enterprise bargaining and union engagement.

      Caitlin holds a Bachelor of Business (Marketing) and Bachelor of Laws from the University of Newcastle and was admitted to practice in the New South Wales Supreme Court and the High Court of Australia in 2015.

      What's included in the price?

      Course training booklet will be sent via post (no soft copies are provided).  Please provide the address when booking, and please provide your home address if working from home and would like it sent there.

      Who can attend?

      This course is open to all organisations excluding other legal service providers.

      Suited for: HR executives, HR Managers, People and Culture Managers, HR Business partners and anyone responsible for managing employees or dealing with workplace complaints.

      What's the refund policy?

      Participants will receive a full refund if they cancel at least seven (7) business days prior to the scheduled event. However, if participants cancel less than seven (7) business days before the event, no refund will be made. The place can be transfered to another member of the paid organisation. No-shows or cancellations after 7 days will receive the course training material and supporting documents. If there are insufficient participants, we reserve the right to cancel the event and participants will be transferred to another module of equal value or receive a full refund at their election. We will give three business days’ notice of any such cancellation.
