As laws criminalising wage theft in Australia are now in effect, getting rostering right in the retail industry is imperative. Wage compliance is now strictly enforced and requires an understanding of the complex rules of the General Retail Industry Award 2020 (Retail Award).
The Retail Award has complex and interconnecting rostering rules. Employers must comply with requirements around hours of work, rest breaks, consecutive days of work, and consecutive days off to name just a few.
Common causes of non-compliance often stem from poor understanding of these rules, administrative errors, or deliberate disregard for the legal obligations tied to rostering. Non-compliance can lead to significant consequences such as reputational damage, civil penalties from the Fair Work Ombudsman and criminal prosecution.
