Topic: Attorney’s Behaving Badly – Part 4 – Remedies
Attorneys are part of the fabric of our social, political and legal structures which encourage individuals to make their own arrangements as to who will manage their affairs when or if they are unable to themselves; But with much power comes much responsibility and the opportunity for misuse and abuse!
The remedies for breach of an attorney’s duties are a subset of equitable remedies; However there are specific and unique remedies available for breach of attorney duties that are not available in other contexts.
This seminar will provide an overview of the ‘arrows in the quiver’ available to be utilised by concerned persons seeking to prevent the exploitation or financial abuse of a relative or friend and will include:
- Remedies available through a court process including: Freezing Orders, Search Orders, Delivery Up Orders, Preliminary Discovery and Tracing.
- Remedies available through the Tribunal and factors to consider in weighing up a choice of forum.
