    Topic: Avoiding costly mistakes in amending or varying trust deeds

    This topic will cover:

    Avoiding mistakes in amending a trust deed to correct an error:

    1. Is an amendment necessary? 
    2. If so, how can the deed be amended?
    3. Can an amendment have retrospective effect?
    4. Avoiding adverse income tax and CGT consequences  

    Avoiding mistakes in varying a trust deed:

    1. Is the proposed variation authorised by the trust deed?
    2. Court ordered variations: scope and limitations
    3. Can a variation have retrospective effect?
    4. Avoiding adverse income tax and CGT consequences
