STEP Victoria-Tasmania Seminar | Thursday 15 August 2024
Event description
STEP Victoria - Tasmania Branch invites you to a seminar with Hayley Hunter and Lachlan Einsiedel, Suzanne Lyttleton Lawyers.
Topic: McFarlane v McFarlane, undue influence in later life transactions and solicitor’s duties
This seminar will discuss:
The decision of Justice Richards in McFarlane v McFarlane [2021] VSC 197 has it all: a self-represented litigant, accusations of treason and attempted imprisonment of the judge. Putting the drama to one side, the decision deals with some fundamental elements of financial elder abuse – undue influence, unconscionable conduct and the duties of a solicitor when faced with a client at risk.
The presentation will take attendees through the decision with particular focus on the red flags of undue influence and unconscionable conduct that ought to have been apparent to Ms McFarlane’s solicitor had proper practice been adopted.
DATE: Thursday 15 August 2024
