STEP Victoria - Tasmania Branch invites you to a seminar with Kimberley Martin TEP, Director WMM Law, hosted by Australian Unity Trustees.   

Topic: Witnessing from Afar - From Pen to Pixel: Navigating E-Signatures and Remote Witnessing in Succession Planning

This presentation focusses on how succession lawyers can ensure that the legal challenges associated with electronic signatures and remote witnessing are mitigated. Key issues/topics covered include:

  • the historical requirements of executing succession planning documents;

  • the rise and use of electronic signatures;

  • the current status of legislation around Australia relevant to the use of technology in succession planning and anticipated legislative reform in this area

  • overview of other legal challenges associated with electronically witnessed and remotely witnessed documents, such as questions around authenticity, identity and revocation; and

  • practice tips for those who offer execution by electronic signature and/or remote witnessing.

SPEAKER | Kimberley Martin TEP

Kimberley Martin B.A. LL.B. (Hons), LL.M, TEP is a senior estate planning, commercial, tax and trusts lawyer at Director level.   Kimberley’s range of expertise includes estate planning, tax, business succession, trusts and superannuation law, with a particular emphasis on complex needs, international, and high net worth estate planning.  She is also experienced in the area of not-for-profit law.

Kimberley holds a Master of Laws (LL.M) in Wills & Estates and is recognised for her influential role in the legal profession at the state, national, and international levels. Her contributions through committee work, publications, and media engagements have earned her international recognition. Her work has been published in 56 countries and featured on platforms such as ABC’s 7:30 program, The Age, and the Sydney Morning Herald. Additionally, she has been published in renowned legal journals, including the Global STEP Journal and the American Bar Association Magazine.
