Understanding Employment Restrictions for Non-Lawyers: Section 121 of the Uniform Law

Community legal centres in NSW, as law practices, are restricted from employing a non-lawyer who is a disqualified person or a person who has been convicted of a serious offence, without approval. This restriction is imposed by the Legal Profession Uniform Law 2014 (Uniform Law) s 121. Approval must be provided by NCAT in order for a law practice to employ a non lawyer who has been convicted of a serious offence. Â
Come along to this informative session to understand who this applies to, how 'serious offence' is defined, the process for applying for approval. We will provide practical tips on how CLCs can ensure they are complying and provide advice or assistance to non-lawyers caught by this provision. We will also talk about the need for reform of this provision, and the work we're doing to seek reform.
