Express Voluntary Assumption of Risk

Participation in the activities at Big Scrub Nature Play carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries.

LIABILITY WAIVER

Participation in the activities at Big Scrub Nature Play carries certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. Although the activities undertaken are carefully planned and supervised by Big Scrub Nature Play staff and volunteers, I, as the legal Guardian for the above-mentioned Participant/s, understand that I am solely responsible to supervise my child/ren at all times.

By attending this event and signing this waiver I agree to the following terms:

I understand that it is my responsibility to ensure that my child and I are dressed appropriately for each activity and acknowledge that I have been briefed on the recommended attire. This includes sun protection, enclosed shoes and wet weather gear.

I understand that I have the sole responsibility for my personal and my child’s safety and possessions before, during and after the program.

I release, waive, and fully discharge Big Scrub Nature Play and Sunshine Butterflies Inc from any and all claims, demands, obligations and liabilities arising from or connected, directly or indirectly, with my and my child/ren’s participation in their outdoor activity programs. This includes breach of contract, and breach of any statutory duty of other duty, and I accept that this release covers and includes, but is not limited to, all unknown and unforeseen claims, injuries, damages and losses, and any consequences thereof.The release is without limitation and includes the personal injury fees, attorney’s fees and any other losses that might occur to the participant. This release shall extend to and include Big Scrub Nature Play and Sunshine Butterflies Inc board of directors, staff, contractors and volunteers including medical and paramedical personnel appointed for the activities, the owners, licensees, and occupiers of land on which the activities or any part of it are conducted or which is involved directly or indirectly with the activities in any manner whatsoever. This release and indemnity continues forever and binds my heirs, executors, personal representative and assigns.
Big Scrub Nature Play maintains that the right to refuse the participation in the event if they foresee that participation would risk damage to any party.

I understand that I will be requested to sign this liability waiver at the beginning of this program and my enrolment is subject to agreement to the terms and conditions stated in the waiver.
