    Taking place at Bethel Farm, Yoga and Livings Arts Center in rural New Hampshire, you'll be free to explore the best in music, art and family friendly camping that our region has to offer. Based on the principles of "Leave No Trace" and "Inclusion", the Barefoot Music and Arts Festival is a truly grassroots festival! Please remember to carpool to this event as parking is limited.

    Gate will be open at: 10am-3pm Saturday, 10am-3pm on Sunday

    Gate will close at: 11pm Sunday

    Terms and Conditions, Waiver and release of Liability Agreement

    References herein to “you” shall refer to any Ticket Purchaser or Ticket Holder including but not limited to any and all volunters, artists and performers and guests of aforementioned. References herein to Organizers shall include the Event and Venue.

    As a consideration for being allowed entry to and participation in the “Barefoot Music and Arts Festival” being provided and produced by Barefoot Music and Arts LLC (Event) on August 10-11, 2023 at Bethel farm, Yoga and Living Arts Center 34 Bethel Rd, Hillsboro, NH (Venue), the person holding the ticket (Ticket Holder) agrees to comply with any and all rules, regulations, terms, and conditions of Organizer and of the Event, including but not limited to all of the terms outlined in this document

    By purchasing/using a ticket or attending the Event by entering any Venue facility, premise (including without limitation, the Venue), Ticket Holder acknowledges having read this waiver of liabillity and release agreement, understands its meaning and legal implications, and agrees to these Terms and Conditions and to be bound by them.

    ALL SALES ARE FINAL. NO REFUNDS WILL BE GRANTED FOR ANY REASON. IF THE EVENT IS RESCHEDULED, THE TICKET HOLDER SHALL HAVE THE RIGHT TO USE THE TICKET TO ATTEND THE EVENT AT THE RESCHEDULED DATE AND TIME. IF THE EVENT IS CANCELED (AND NOT RESCHEDULED), ORGANIZERS WILL ESTABLISH POLICIES AND PROCEDURES FOR PURCHASED TICKETS AT THE TIME OF CANCELLATION. 

    If Organizers elect, in their sole discretion, to refund any purchased ticket, service fees charged by the Event’s ticketing service provider, if any, are non-refundable.

    Tickets bear no cash value and are not redeemable for cash. Tickets are not subject to exchange except as expressly provided above. If issued as a complimentary ticket, the ticket is not exchangeable or redeemable for another ticket to or for any other event or performance or for any other consideration, present or future, monetary or otherwise. PURCHASER AGREES TO NOT FILE A CHARGEBACK OR ANY TYPE OF PAYMENT REVERSAL FOR ANY REASON. 

    ABSOLUTELY NO WEAPONS, FIREARMS, FIREWORKS, OR EXPLOSIVES OF ANY KIND ARE ALLOWED AT THE EVENT.

    • Assumption of Risks: I UNDERSTAND ACKNOWLEDGE, AND AGREE THAT THAT THE EVENT IS AN INTERACTIVE EVENT AND THAT, AS AN ATTENDEE AND PARTICIPANT THEREIN, I MAY ENGAGE IN ACTIVITIES THAT INVOLVE A SUBSTANTIAL RISK OF PERSONAL INJURY, PROPERTY LOSS AND/OR ECONOMIC LOSS. 
    • These risks may include, but are not limited to, those caused by, arising out of or in connection with: (1) the actions or inactions of myself the TICKET HOLDER  (2) conditions of the Venue, premises or equipment used; (3) conditions of attendees, participants, performers, and artists; (4) art sculptures; (5) fire and flame effects; (6) staging; (7) raccoons, bears, insects, ticks, reptiles or other wildlife; (8) the pond or other bodies of water, swimming, water activities (9) vehicular traffic; and/or (10) infection by COVID-19 or any other communicable disease or illness, or a bacteria, virus, or other pathogen. Ticket Holder further acknowledges and fully understands that there may also be other risks that are presently unknown or unforeseeable. Art installations, motorized vehicles, bicycles, tent structures, and camping equipment are not installed, owned or operated by Organizers, and TICKET HOLDER KNOWINGLY AND FREELY ASSUMES ALL RISK OF LOSS, INJURY OR DEATH CAUSED BY, ARISING OUT OF OR IN CONNECTION WITH THEIR OPERATION OR USE.​
    • I voluntarily assume all such risks and accept full responsibility for any injury, loss, or damage that may occur as a result of my participation.
    • Release of Liability: I hereby release, waive, discharge, and covenant not to sue Event or Venue, its officers, employees, agents, and representatives from any and all claims, demands, liabilities, actions, or causes of action arising out of or related to any loss, damage, or injury, including but not limited to personal injury, property damage, or wrongful death, whether caused by negligence or any other act or omission of any of the released parties, during or in connection with my participation in the Event
    • Indemnification: I agree to indemnify and hold harmless the Event from any and all claims, demands, liabilities, actions, or causes of action, including attorneys' fees and costs, arising out of or related to my participation in the Event. 
    • This release and indemnity section includes, but is not limited to: third party claims, claims for personal injury or wrongful death (including claims related to emergency, medical, drug, and/or health issues, response, assessment, or treatment), loss of consortium, breach of contract, or any other claim, including claims resulting from the negligence of Organizers, whether passive or active, related to the Event.
    • Medical Treatment: In the event of any injury or illness during my participation in the activity/event, I authorize the Event and its representatives to seek and consent to any necessary medical treatment on my behalf.
    • Photographic Release: I grant Barefoot Music and Arts LLC the right to take photographs and/or video recordings of me during the Event and to use such materials for promotional purposes without compensation to me.
    • Severability: If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
    • Governing Law: This agreement shall be governed by and construed in accordance with the laws of New Hampshire.
    • Entire Agreement: This agreement constitutes the entire understanding between the parties concerning the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral.

    By purchasing your ticket, you acknowledge that you have read and understood this waiver of liability and release agreement and voluntarily agree to its terms and conditions.
