Trusts are the investment vehicles of choice for many wealthy families. To properly advise clients with trust structures, it is essential for family lawyers to keep up to date with trust law and the taxation issues concerning trusts, both of which are in a constant state of flux.
This seminar will cover a number of recent changes (as well as some classic evergreen issues) concerning trusts, including:
- Section 100A (reimbursement agreements)
- The High Court decision in Carter v FCT (disclaimers)
- Are the amendments to my trust valid? (Mercanti and other cases)
- Does my trust need to be updated? (Is it time for a "health check"?)
- Succession of family trusts (a will is not enough)
- Family trust elections (the often missed issue)
- Child maintenance trusts (and other bespoke trusts)
The goal of this session is not to turn you into a trust or taxation expert, but rather to give you the knowledge to identify issues that may arise for your clients.
