When a client's memory or thinking is in question, a will or an LPA can be challenged years later. Often it comes down to one question: did this person have the capacity to make that decision?
Dr Judy Tang OAM is a clinical neuropsychologist. Her work is testing how well a person's memory, reasoning and judgment are working, and explaining what that means for a legal decision. In this relaxed 90-minute session, she will share what this kind of evidence can and cannot show, and how to get the most from it.
Dr Tang will talk about:
early signs that a client's capacity may be in question
wills after XBO v XBP and WWI v WWJ, and why a quick screening test is often not enough
deputyship and LPA disputes, and the evidence courts look for
how to instruct a neuropsychologist, and how to read the report you get back
In this session, you will learn when to bring in an expert, and how a timely assessment can protect your client's wishes, ideally before the document is signed.
No background in psychology is needed. Everything is explained step by step, with plenty of time for your questions. Light refreshments provided.
