Work Capacity & Decision Making Capacity: Expert Opinions from Neuropsychology (Malaysia)
Description
When a client has had a brain injury, a stroke, or early dementia, two questions matter. Can this person still work? And can this person still make their own decisions about money, contracts, or a will? That second question is called decision-making capacity. It is often missed.
Dr Judy Tang OAM, a clinical neuropsychologist, will explain both questions in simple terms. A neuropsychologist tests how a person's brain is working: their memory, thinking and judgment. The results give you clear, objective evidence for an insurer or a court, instead of impressions alone.
Dr Tang will share:
how to spot when a client's thinking may be affected
how this evidence can strengthen SOCSO/PERKESO and injury claims
how testing capacity early protects wills and financial arrangements from challenge (Banks v Goodfellow; Chin Jhin Thien [2020] FC)
how to instruct an expert under section 45 of the Evidence Act, including checking your expert is registered under Act 774
In this session, you will learn when to bring in a neuropsychologist, what to ask for, and how to read the report you get back. No background in psychology is needed. Everything is explained step by step.
You will leave with practical steps you can use straight away, and there is plenty of time to ask your questions. Light refreshments provided.
For lawyers, insurance professionals and case managers. RM 80, charged as SGD 25 at checkout. In-house sessions on request.
