The seminar will cover:
Where parties to a marriage or de facto relationship both make contributions to the acquisition or development of property, which is held in the name of one party only, the other party may be able to assert an interest in that property based on the (under-utilised) doctrine of the ‘common intention’ trust. This presentation discusses the circumstances in which a ‘common intention’ trust may arise, and the leading cases applicable to common intention trusts.
About the speaker:
Chris Bailey
Chris is a barrister at Francis Burt Chambers, practising in civil litigation. His specific areas of interest includes wills and estates litigation, insurance, professional negligence and professional regulation.
Chris commenced his career as an Associate to Justice Buss and Justice Owen at the Supreme Court of Western Australia. Prior to being elected to the bar, Chris conducted disciplinary prosecutions for the Legal Practice Board and spent over a decade practising in commercial litigation at Williams & Hughes.
