The case: Ship Happens Freight Ltd v Safe As Houses Insurance Co

When a company is rocked by a catastrophic $5 million D&O claim following a Federal Police raid and allegations of foreign bribery, its insurer refuses indemnity on the basis of alleged fraudulent non-disclosure by its CEO.

But the CEO denies any wrongdoing. The so‑called “bribes” were nothing more than local marketing expenses. And in any event, if the policy is avoided, the CEO says the fault lies squarely with the insurance broker…

Who knew what, and when? Was the insurer’s denial justified? What will emerge under cross-examination?
