Justice Brian Preston has been fighting for the environment for years. In 1985 he was co-founder and principal solicitor of the Environmental Defenders Office of NSW. In 2005 he was appointed Chief Judge of the NSW Land and Environment Court. He says, If you have a degraded environment, you’re impoverished.
The battle to protect the environment from man-made climate change is being fought on many fronts. In recent years climate litigation has come to the fore around the world as a way of forcing governments and industry to act. In a recent case Justice Preston found that the NSW Environment Protection Authority had a legal duty to develop environmental quality objectives, guidelines and policies to ensure environment protection from climate change. Can inaction on climate be considered a breach of human rights?
