Safeguarding Stories – Protecting ICIP in the Publishing Process

First Nations peoples have been telling stories for tens of thousands of years, passing them down through generations. Cultural stories are the Indigenous Cultural and Intellectual Property (ICIP) of First Nations peoples. Throughout history, First Nations people have been studied, written about, and have had their personal and cultural stories shared without their permission, and usually in derogatory and incorrect ways. Although this is gradually changing, recent events in the publishing sector have shown us there is still a long way to go. In this Law Way® session, learn how to respect ICIP in the publishing process, write First Nations characters and stories in a respectful and authentic way, and most importantly, ensure First Nations people have a seat at the table in the publishing process. This Law Way® session will be hosted by Senior Solicitor Laura Curtis, who has significant experience advising on ICIP, Indigenous languages, publishing, literary expression, and libraries.

Presenters

Dr Terri Janke, Solicitor Director (Facilitator) is a Wuthathi/Yadhaighana and Meriam woman and an international authority on Indigenous Cultural and Intellectual Property (ICIP), known for innovating pathways between the non-Indigenous business sector and Indigenous people in business. Terri advises on legal matters including intellectual property, business law, and governance of Indigenous organisations. She has written leading ICIP Protocols and models for various sectors including the arts, museums, archives, film and business. Terri is a co-author of the Australia’s State of the Environment Report, and the author of True Tracks: Respecting Indigenous Knowledge and Culture.

Laura Curtis, Senior Solicitor (Presenter) is a non-Indigenous lawyer at Terri Janke and Company. Laura has experience in drafting publishing agreements for both authors and publishers. She has worked with major publishing houses, the Indigenous Literacy Foundation and wrote the revised More than Words: Writing, Aboriginal and Torres Strait Islander Culture and Copyright in Australia for the Australian Society of Authors. This is a practical guide for authors, illustrators, and publishers on respectful storytelling practices when working First Nations peoples and their ICIP.
