DECLARATION OF ACKNOWLEDGEMENTS, AGREEMENTS AND INDEMNITY PROVISIONS
 
As consideration for being permitted to register and participate in the Manly Trivia Trail (“Event” or “Activities”) operated by The Manly Club of Rotary ABN 39 512 728 164 (“Operator”), you agree to all the terms and conditions set out below (“Agreement”).
 
By registering and participating in the Event, you acknowledge and agree to be bound by the terms and conditions set out below or in any material which has been, or caused to have been distributed by the Operator relating to the Event, as amended from time to time.  
 
1.      AUTHORITY TO REGISTER
 
Each participant represents and warrants to the Operator that you have full legal authority to complete the Event registration on behalf of yourself and/or any party you are registering ("Registered Parties"), including full authority to make use of the credit or debit card to which registration fees will be charged. If you are registering a child under the age of 13 or an incapacitated adult, you represent and warrant that you are the parent or legal guardian of that party and have the legal authority to enter into this Agreement on their behalf and agree that all sections of this Agreement shall apply equally to all Registered Parties as if the Registered Party were completing the Event registration. For the avoidance of doubt, references to “you” or “your” apply to Registered Parties. If you are under the age of 18 or the age of majority, you represent and warrant that your parent or legal guardian on your behalf agrees to this Agreement and Waiver and consents to the collection of your personal information which you provide for the purposes of registration.
 
2.      ACKNOWLEDGEMENT AND WAIVER
 
You are voluntarily participating in the Event and understand that participation in the event is potentially hazardous, and that a registered party should not participate unless they are able and properly supervised (if applicable). You understand that the Activities may occur over public roads and facilities open to the public during participation in the Activities and upon which hazards are to be expected. Participation carries with it certain inherent risks that cannot be eliminated completely ranging from minor injuries to catastrophic injuries including death. You understand and agree that in consideration of being permitted to participate in the Activities, you or any Registered Party, the heirs, personal representatives or assigns of you or the Registered Party do hereby release, waive, discharge and covenant not to sue the Operator or its agents, directors, employees, members, partners, sponsors, promoters, volunteers, the owner of all buildings in which, or close to which, the Activities takes place and any person directly or indirectly associated with the Event in any way (“Operator Affiliates”) for any and all liability from any and all claims, demands and proceedings arising out of or connected with participation in the Event by you or any registered party. You agree to assume your own medical expenses in the event of an accident or other injury resulting from or occurring due to or in connection with your participation in the Activities.
 
You fully understand you are forever giving up in advance any right to sue or make any claim against the Operator or any Operator Affiliates if you suffer such injuries and damages even though you do not know what or how extensive those injuries and damages might be and are voluntarily assuming the risk of such injuries and damage.
 
You acknowledge and declare that you are not aware of any medical condition or disability which precludes you from safely participating in or limits your capacity to participate in the Activities. If you become aware of any such condition or disability you agree to withdraw from the Activities immediately.
 
You agree to take all reasonable care and precaution to ensure that you do not cause or risk any harm or injury to any other participant in the Activities, any person who you might interact with in public spaces which the Activities occurs.
 
3.      INDEMNIFICATION
 
You agree to and hereby indemnify and hold each of the Operator and Operator Affiliates harmless from and against all liability for any injury, loss, damage, costs, claims or demands arising out of or in connection with participation in the Activities by you, or caused by a breach of the terms of this Agreement whether suffered by you or caused by you to another person. This release applies during the Activities and will continue without lapsing thereafter and it binds my heirs, successors, executors, personal representatives and assigns.

 
4.      PRIVACY DECLARATION
 
The personal information collected from this entry form / ticket purchase will be used for administration purposes to communicate with and identify participants and record results. It will not be divulged to any third party but may be used to inform you of future events.
