32 Currawong Road Baw Baw Village VIC 3833 Refund policy Refunds, Cancellations & Ticket Resale Policy
1. General Refund Policy
All ticket sales are final and non-refundable, except where required by Australian Consumer Law.
As a small, independently operated festival, Diega works within tight financial margins, with ticket revenue committed to artists, infrastructure, suppliers, permits and essential event costs well in advance. Unfortunately, the realities of producing an independent festival mean we are unable to accommodate individual refund requests.
Refunds will not be issued for change of mind, inability to attend, personal circumstances, illness, travel disruptions or changes to personal plans, unless required by law.
We encourage all ticket holders to carefully consider their availability and circumstances before purchasing.
2. Event Cancellation or Postponement
Cancellation by the Organiser
If the festival is cancelled and not rescheduled, ticket holders will receive a refund of 90% of the ticket face value, with 10% retained to cover non-recoverable costs associated with organising the event, including deposits, permits, site hire, insurance, artist fees and infrastructure commitments.
The 10% non-refundable portion applies only where permitted by law. Where Australian Consumer Law requires a greater refund, those statutory rights will prevail.
Postponement
If the festival is postponed, all tickets will automatically remain valid for the rescheduled dates.
Ticket holders unable to attend the new dates may request a refund within 14 days of the postponement announcement. Where permitted by law, a 10% non-refundable portion of the ticket face value will be retained to cover costs already incurred. Any statutory refund entitlements will take precedence.
Circumstances Beyond Our Control (Force Majeure)
In the event of cancellation or postponement due to circumstances beyond our reasonable control, including extreme weather, bushfire risk, natural disasters, government restrictions, public health emergencies or emergency services directives, Diega will offer a 90% refund of the ticket face value, retaining 10% to contribute towards non-recoverable event costs, where permitted by law.
Refund entitlements will remain subject to Australian Consumer Law.
3. Changes to Event Details
Diega reserves the right to make reasonable changes to the festival programme, artist lineup, venue, operating hours, facilities and amenities where necessary.
Minor changes do not automatically entitle ticket holders to a refund.
Where a significant change materially alters the event purchased, ticket holders may be entitled to a refund or other remedy under Australian Consumer Law.
4. Ticket Resale & Transfers
Private Ticket Resale
Ticket holders who can no longer attend are welcome to arrange a private sale or transfer of their ticket to another person, provided the resale complies with applicable laws and ticketing conditions.
Any private resale is the responsibility of the buyer and seller. Diega is not responsible for payments, fraudulent transactions or disputes arising from private sales.
Tickets must not be resold above the maximum price permitted by applicable ticket resale laws.
Official Humanitix Resale
Once the festival has sold out, we intend to activate the official ticket resale facility through Humanitix, allowing ticket holders who can no longer attend to offer their tickets to others looking to join us.
The official resale service will not be available until all festival tickets have sold out.
Once activated, ticket holders can access the resale option through the Manage Order link in their original Humanitix confirmation email.
Listing a ticket for resale does not guarantee that it will be purchased. Any applicable resale fees or conditions will be outlined by Humanitix.
5. Refund Requests & Processing
Where a refund is available under this policy or required by law, requests must be submitted in writing to Diega or through Humanitix.
Please include your full name, order number, contact details and reason for the request.
Approved refunds will generally be returned to the original payment method. Processing times may vary depending on the ticketing platform and financial institution.
6. Booking & Service Fees
Booking fees, payment processing charges and other third-party service fees are generally non-refundable, except where required by law.
Any applicable deductions will be communicated when a refund is processed.
7. Additional Expenses & Liability
Diega is not responsible for personal expenses incurred in connection with attending the festival, including travel, accommodation, transport arrangements or other associated costs, except where liability cannot lawfully be excluded.
We recommend considering suitable travel insurance for any significant additional expenses.
8. Australian Consumer Law
Nothing in this policy excludes, restricts or modifies any rights or remedies available to ticket holders under the Australian Consumer Law or other applicable legislation.
Where these rights conflict with any provision of this policy, the applicable law will prevail.
