You are a local applying for a 2×3m car site or 3x3 Marquee site in the outdoor summer market located at The Project Space Apollo Bay. If you need a bigger space buy multiples of the dimensions required.

This fee is only for stall holders the car-boot sale is Free or Gold coin donation.

If driving onto the property please advise when you get there for your allocated spot.

TERMS & CONDITIONS FOR FLOREO CREATIVE PROJECT SPACE MARKETS

1. The Market stall holder agrees to pay The Project Space (Floreo creative) as per the agreed amount for the time period. Cancellations and rescheduling are not permitted within 7 days. 50% Refunds are given 14 days before the scheduled booking. Full refunds will be given at the discretion of The Project Space, Floreo Creative Project Space.

2. Floreo Creative is not liable to the stallholders for any loss suffered by stallholders arising out of the use of the project space. The Hirer releases the Floreo Creative from any claim made against Floreo Creative arising out of, in connection with, or caused by the stallholders use of the Floreo Creative project space.

3. The stallholders indemnifies Floreo Creative from and against all claims, demands, actions, costs, and expenses arising out of, in connection with, or caused by the stallholders use of Floreo Creative Project Space.

4. The Hirer agrees to have and maintain a COVID SAFE Plan consistent with the requirements of Vic Health.

5. The stallholders agrees to reimburse Floreo Creative for the full cost of repairing any damage caused to the project space or facilities during the hire period.

6. The stallholders agrees to notify Floreo Creative of all injuries or damage arising out of the stallholders use of the project space within 7 days of becoming aware of the injury or damage.

7. The stallholders acknowledges receipt of the Conditions for Hire of the project space and agrees to those conditions.

Hirer’s Liability

a. The stallholders must not do or allow to be done on or in relation to the facility anything which may or does cause damage.

b. Nothing permanent or semi-permanent is to be fixed to the property, or any part of the building, nor shall signs, scenery be erected without the express permission of the Booking Officer. Temporary attachments may be made using non-marking and non-damaging products.

c. Any damage, or cleaning of the facility if it is not left in the condition the stallholders found it in, as assessed by the Booking Officer, must be paid for within two weeks of notification to The stallholder.

d. Should any damage occur, the Booking Officer’s assessment shall be final.

Disputes

a. In the case of any disputes arising, the decision of Floreo Creative will be final.

Condition of Facility

a. Floreo creative makes no warranty or representation to the stallholders about the condition of the Facility or its suitability for the stallholders’s purpose.

b. The condition of the Facility should be left in the same condition as the hirer found it noting:
1. Chairs are to be stacked neatly;
2. All rubbish to be removed from the Facility;
3. All external doors are to be locked;

Use of the Facility

General

a. The stallholders must not breach any of these Conditions of Hire.

b. Use of The Facility by the stallholders is at the risk of the stallholders at all times.

f. The stallholdersis aware that the Facility is in a residential area and that all persons attending the Facility must refrain from any behaviour which could be reasonably construed as disturbing the neighbours or infringing on the person’s property and/or rights.

g. The stallholders of the Facility and guests are confined to the Facility and its accompanying amenities.

h. Floreo Creative accepts no responsibility for private property left in the Facility.

Planned Activities/Entertainment

a. Entertainment that is not in keeping with the values and standards of the Parish will not be permitted.

b. Noise must be contained within the requirements of the council. Music must cease at midnight on Fridays and Saturdays, 10.00pm on Sundays and 11.00pm on all other days.

c. It is the responsibility of the stallholders to obtain any necessary permits from the relevant authorities as required for planned activities.

Alcohol

a. Approval for the consumption of alcohol is at the discretion of the Booking Officer and must be requested by the stallholders if required.

b. Under no circumstances shall liquor be sold until approval from the Booking Officer has been obtained and the necessary liquor permit is sighted at the time of obtaining the key to the facility.

c. Approval for the consumption of alcohol may be withdrawn at the discretion of the Booking Officer.

d. Normal liquor regulations apply. Alcohol is not to be served to guests under 18 years of age.

Smoking

Smoking is not permitted in the Facility.
