Private Practice: Ethical, Legal, and Professional Issues for Therapists

Private practice is changing quickly and involves many new challenges and opportunities. This in-person seminar explores a variety of timely and critical ethical, legal, and professional issues that pertain to private practice and equips participants with the key resources they will need. The seminar is designed for all therapists in private practice, whether they have had a private practice for years or are just starting out.

The seminar is packed (see below) with practical information for therapists in private practice. The amount of information participants will receive is equivalent to many two-day seminars. Examples of topics that will be addressed during the seminar and/or are included in supplemental materials:

developments in the field -- why this is a good time to be in private practice
teletherapy essentials for therapists in private practice
interjurisdictional practice -- the five provisions for legal practice across state lines
interstate compacts -- game changers for therapists in private practice
interstate compacts -- latest information, websites, and resources specific to each license type
myths, misunderstandings, and misinformation about teletherapy & practicing across state lines
revenue streams -- determining what services you should (or should not) offer
Four excellent but little-known resources (licensing boards use these for guidance)
Business Associate Agreements (BAAs) -- when and why you must have them
advertising/marketing pitfalls (e.g., listing credentials, testimonials, fee-splitting)
supervision -- unforeseen risks (e.g., "the supervision triangle")
social media -- four important issues
understanding/thinking like a licensing board
cloud-based practice management systems
referral streams -- the importance of multiple streams
hidden risks involving boundaries, power differentials, & multiple relationships
essential policies (e.g., communications/social media, fees, & more)
informed consent process -- critical elements that are often overlooked

Seminar speaker:

Terry Casey, Ph.D., Licensed Psychologist, HSP (TN #1975) conducts a variety of webinars/seminars for counseling and mental health professionals across the country. For the past 15 years he has taught Ethical & Professional Issues in Counseling in Lipscomb University's CACREP-accredited M.S. program in Clinical Mental Health Counseling. For 17 years he served as the Clinical Director for a large counseling and psychological services organization based in Nashville. He also served for several years as the Chair of the Ethics Committee Chair for a state-level professional organization. Dr. Casey has a private consulting practice in Franklin, Tennessee.

Navigate codes of ethics, federal laws, state statutes, and licensing rules.
Discuss key legal and ethical aspects of private practice.
Identify the legal and ethical essentials regarding teletherapy, social media, and communication technologies.
Describe the current legal and ethical requirements for interjurisdictional practice and the implications for private practices.
Discuss special operational aspects of private practice including advertising, policies, referral streams, sources of revenue, and supervision of trainees.
Apply the Multiple Perspective Model of decision-making to case vignettes involving private practice.

Continuing education credit: This seminar provides 6 CE hours through Lipscomb University’s M.S. program in Clinical Mental Health Counseling, a pre-approved provider of continuing education for the following Tennessee license types: LPC & LPC/MHSP, LCSW, Licensed Psychologist & LSPE, LMFT, LCPT, LDAC. Venue:

The seminar will be held in the Ezell Center (#2 on campus map) Rm#157 which is connected to the George Shinn Event Center (#1 on campus map). Note: If you enter the main entrance of the Shinn Event Center you can simply go down the stairs and continue straight ahead to the Ezell Center and then on through the atrium to the Board Room.

Parking:

Parking on campus can sometimes be a challenge when the University is in session. At times as there are limited spaces for visitors near the Ezell Center/Shinn Center. Therefore, it is recommended that you plan to arrive on campus early (by 7:15-7:30) to allow for parking, walking to the Ezell Center (#2 on the campus map), and signing in at the door. Again, early arrival is recommended.

There are several on-campus food options. The Bennett Center (#32 on the map) contains a food court that includes Starbucks (usually opens at 7:00 am), Chik-fil-a, Blue Coast Burrito, and other options. Also, the main campus dining hall is upstairs from the food court. There is also a Roast8 cafe in the Student Activities Center (#45 on map) within a few feet of the Ezell Center's entrance near the bell tower (#46 on map). The lunch break will be one hour. Some past participants have found that bringing their own lunch can be a convenient option. Going off campus for lunch is not recommended due to the time involved and the possibility of parking problems upon return.
