  PURPLE SPARK ADVISORY – EVENT BOOKING TERMS

  Terms and Conditions

  1.      Agreement: These terms and conditions (Terms) are between Purple Spark Advisory Pty Ltd (ACN 686 070 039) (we, us or our) and you, the person registering to attend the Event (you or your).

  2.      Acceptance: You accept these Terms by completing the registration form, submitting your booking for the Event and clicking “I accept”.

  3.      Event: We will host a beta testing event (Event) on 16 June 2026 in Melbourne. The Event will include product demonstrations, feedback sessions and beta testing activities. We reserve the right to make reasonable changes to the Event program, format or timing and will notify you of any material changes as soon as practicable.

  4.      Bookings: Attendance at the Event is free of charge and by registration only. To register, you must provide your full name, email address and phone number via our registration form. Your booking is confirmed once we send a confirmation email to you.

  5.      Food and Dietary Requirements: We will provide catering at the Event. Following your booking confirmation, we will contact you to ask about any dietary requirements or allergies. It is your responsibility to notify us accurately of any relevant dietary requirements. We will take reasonable steps to accommodate dietary requirements notified to us in advance. We are not liable for any allergic reaction or dietary issue arising from your failure to notify us of a relevant requirement.

  6.      Cancellations and rescheduling by you: You may cancel your registration at any time by notifying us. We would appreciate as much notice as possible so we can manage event numbers.

  7.      Cancellations and rescheduling by us: We reserve the right to cancel, postpone or reschedule the Event at any time. If we cancel the Event, we will notify you as soon as practicable. As the Event is free of charge, we will not be liable for any costs or losses you incur as a result of a cancellation or rescheduling.

  8.      Your Obligations: By registering for and attending the Event, you agree to:

  (a)          comply with our reasonable requests and requirements;

  (b)         provide accurate and complete information to us when registering;

  (c)          not attend the Event if you are experiencing any illness that could pose a risk to the health or safety of other attendees or staff;

  (d)         inform us of any physical or medical conditions that may affect your participation in the Event;

  (e)         comply with all reasonable directions given by us or the venue at the Event;

  (f)          comply with the rules and requirements of the venue at which the Event is held;

  (g)          treat all equipment, materials and other attendees with respect; and

  (h)         not record, photograph, film or screenshot any part of the Event or any materials presented at the Event without our prior written consent.

  9.      Photography and Recording: We may take photographs or recordings at the Event for our internal records and promotional purposes. By registering for and attending the Event, you consent to us using any photographs or recordings taken at the Event in which you appear for promotional and marketing purposes, including on our website and social media channels. If you do not wish to be photographed or recorded, please notify us prior to the Event or inform a member of our team at the Event and we will take reasonable steps to accommodate your request.

  10.    Intellectual Property: All intellectual property rights in our product, technology, demonstrations, materials and any other content presented at the Event remain our property at all times. Nothing in these Terms transfers any intellectual property rights to you. Any feedback, suggestions or ideas you provide in connection with the Event or our product are provided on a non-confidential basis and may be used by us freely without obligation or compensation to you. To the extent any intellectual property rights arise in such feedback, you assign those rights to us.

  11.    Privacy and Data Collection: When you register for the Event, we will collect your name, email address and phone number. We may also collect information about your dietary requirements or allergies. We collect this information to manage your registration and attendance at the Event. We will handle your personal information in accordance with our privacy policy and the Privacy Act 1988 (Cth). We will not disclose your personal information to third parties except as required to organise the Event or as required by law. By registering for the Event, you consent to us contacting you by email or phone in connection with the Event.

  12.    Removal from Event: We reserve the right to refuse entry to, or remove from, the Event any person who:

  (a)          breaches these Terms or the Non-Disclosure Agreement;

  (b)         behaves in a manner that is disruptive, unsafe or inappropriate; or

  (c)          poses a risk to the health, safety or wellbeing of other attendees or staff.

  13.    Liability: We will take reasonable care in organising and hosting the Event. However, to the maximum extent permitted by law:

  (a)          we are not liable for any indirect or consequential losses that may arise in connection with the Event or these Terms; and

  (b)         subject to your consumer law rights, our total liability under these Terms is limited to $1,000.

  Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other applicable legislation that cannot be excluded.

  14.    Confidentiality: Both parties commit to maintaining the confidentiality of any proprietary or confidential information shared while these Terms are in place. Your confidentiality obligations in relation to information disclosed at the Event are also governed by our Non-Disclosure Agreement, which you will be asked to accept at check-in.

  15.    Governing Law: This Agreement is governed by the laws of Victoria. Each party submits to the non-exclusive jurisdiction of the courts of Victoria.

  16.    Dispute Resolution: If a dispute arises in connection with these Terms, the parties agree to first attempt to resolve it through good faith discussion. If the dispute is not resolved within 10 Business Days of written notice, either party may refer the matter to mediation. Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief.

  17.    Definitions: In these Terms:

  (a)          Business Day means a day on which banks are open for general banking business in Melbourne, Victoria, excluding Saturdays, Sundays and public holidays.

  (b)         Non-Disclosure Agreement means the non-disclosure agreement presented to you at check-in at the Event.

  (c)          Terms means these terms and conditions, as updated from time to time.
