Topic: Cardaci: lessons for trust litigation?

The unanimous decision by the WA Court of Appeal in Cardaci effectively ended a 7-year long dispute between Mae Cardaci and her brother-in-law Philip Cardaci regarding the late Marc Cardaci’s estate and two trusts, which held substantial assets.  Special leave to the High Court was sought but refused. Cardaci involved and considered many aspects of trusts and trust litigation and is therefore a key case for trust litigation in Australia.  Some of the key issues considered by the WA Court of Appeal included the impact of a memorandum of wishes, breach of trustee duties, trustee conduct generally, rights of beneficiaries, offers of settlement by a trustee to a beneficiary, acting as executor and trustee, the fair dealing rule, a trustee’s right of indemnity from the assets of a trust, the extent to which a trustee can rely on an exemption clause notwithstanding breaches of trust, and the impact of a trustee failing to seek judicial advice in hostile litigation.
