Topic: Crypto in the Estate: Administration, Risk and Recovery

This presentation examines the legal and practical issues that arise when cryptoassets form part of a deceased estate. The session will provide an overview of the features of cryptoassets relevant to succession practice, including custody structures, wallets, private keys, and crypto exchanges, before considering the challenges of identifying, securing, and administering these assets. It will address questions of access and control, dealing with custodians and exchanges, tracing, and recovery where assets have been transferred or misappropriated, and the implications for estate planning and administration. The session will focus on the practical issues practitioners should consider when advising clients and administering estates with cryptoasset holdings.

About the Presenter | Dr Aaron M. Lane

Dr Aaron Lane is a Barrister at the Victorian Bar and a Senior Lecturer in the School of Law at RMIT University. In legal practice, he has a strong interest in matters involving economic or financial evidence and has advised and appeared in a broad range of cryptocurrency matters including banking, family law, insolvency, proceeds of crime, taxation, and wills & estates – having signed the Bar Roll in 2023. Aaron's legal practice is built on a foundation of award-winning academic research that explores the relationship between regulation and innovation, with a focus on new and emerging technologies.
