This seminar looks at the hidden gaps when incapacity crosses paths with the reality of paperwork, and the post-death gaps that are uncovered after probate. Join us as we work through where the plan starts to unravel, what's missing in the documentation, and how to close the gaps before your clients fall through.

Kyle is a Partner of Klimek & Wijay Family Lawyers. He acts for high-net-worth clients whose matters involve intricate financial issues and structures such as partnerships, family trusts, discretionary trusts, unit trusts, trading companies, self-managed superannuation funds, businesses and other commercial ventures. He regularly advises clients in cases that raise issues at the intersection of family law and related disciplines such as taxation, trusts and bankruptcy.

Session 4 | The 30% minimum tax on discretionary trusts | Daniel Taborsky

The 30% minimum tax on discretionary trusts is proposed to apply from 1 July 2028, and will change how family trusts are taxed and how succession is planned for years to come. In this session, we will work through how the minimum tax will apply in practice, the options open to trustees (electing to distribute on fixed proportions to pre-nominated beneficiaries, restructuring, or accepting the minimum tax) and what each means for succession planning.
