STEP NSW Branch invites you to a seminar with Nicholas Simpson, Barrister, 13th Floor St James.
Topic: Insolvency and Deceased Estates – bankrupt deceased estates, director deaths, personal guarantees, and the impact of deeds of company arrangements on guaranteed corporate debts
The presentation will look at the relevant practice and procedure under the Bankruptcy Act 1966 (Cth) where a deceased person’s estate is insolvent and what relevant regime will apply and how it works in practical terms. The presentation will then address the impacts of the death of a director of a corporation under the Corporations Act 2001 (Cth) as well as instances concerning corporate insolvency where a deceased (acting as a director) has provided personal guarantees and the effect on those debts following the entry and effectuation of a deed of company arrangement.
